Resumo:This paper aims to understand the real situation of the elderly in Brazilian society, analyzing whether Fundamental Rights have been safeguarded as a way of guaranteeing the Dignity of the Human Person. In this sense, it will bring a reflection on the role and importance of the Elderly Statute, Law 10.741 / 2003, as a tool to fight for the rights of the elderly, since it emerges as a specific law to protect the population that reached the third. ensuring the right to life, health, food and housing, access to culture, leisure, transportation, work, sport, citizenship, freedom, the right to be treated with dignity, respect, to live in family and in community. This research will also address the roles of family, society and the state as jointly and severally responsible for defending the rights and guarantees of the elderly. In this perspective, it will address the bias that interweaves Family Law with the Elderly Law, from the perspective of family bonds as guiding threads in the actions of support, assistance and, mainly, as an incentive instrument for the development of new skills even after old age, in order to to grant autonomy and freedom to the elderly in daily tasks. For this, a hypothetical-deductive and qualitative research was conducted, based on applied bibliographic research, as a means of deepening the descriptive objective studies, aiming to obtain a formative evaluation. By conceiving this study, it was possible to better understand the conceptions that permeate the family and social environment in relation to the rights attributed to the Elderly. Thus, it was concluded that there are several relevant attitudes that can be taken to ensure quality of life for the population that has reached old age, but in contrast, there are several challenges to be overcome and that still limit the real sense of the Dignity of the protected human person. Federal Constitution, and the application of the Rights established by the Elderly Statute and the National Elderly Policy.
