The study also aims to discuss the relation between the State's duty and its performance in combating the social question in which these individuals are inserted, since this arises from the fundamental contradiction created by the capitalist mode of production. The research was carried out from a theoretical-methodological perspective of critical-dialectical foundation, from a bibliographical and documental analysis that used the knowledge of scholars in the field, but also the legislation that provides a basis for the performance of social assistance policy in the field of Children and Adolescent’s full protection. In this sense, a survey was carried out on important points of the current Brazilian Federal Constitution, the Child and Adolescent Statute and the National Social Assistance Policy, where some aspects were raised about the effectiveness in the execution of public policies and social programs that vision the full protection of Children and Adolescents. Finally, the importance of ethical-political, theoretical-methodological and technical-operative knowledge of the social worker was considered for the discussion and struggle in defence of these rights, as well as the difficulties encountered by professionals in their daily work. O presente estudo objetiva analisar a atuação do assistente social na discussão acerca da efetivação dos direitos da Criança e do Adolescente e o papel da família, dos entes públicos e da sociedade no que toca ao dever de proteção integral. Busca-se discutir a relação entre o dever do Estado e sua real atuação no combate a questão social em que esses indivíduos estão inseridos, uma vez que essa surge a partir da contradição fundamental criada pelo modo de produção capitalista. A pesquisa foi realizada numa perspectiva teórico-metodológica de fundamentação crítico-dialética, a partir de uma análise bibliográfica e documental que se utilizou do conhecimento de estudiosos da área, mas também da legislação que provê base para a atuação da política socioassistencial no âmbito da proteção a criança e ao adolescente. Nesse sentido, foi feito um levantamento acerca de pontos importantes da Constituição Federal vigente, do Estatuto da Criança e do Adolescente e da Política Nacional de Assistência Social, onde foram levantados alguns aspectos acerca da efetividade na execução de políticas públicas e programas sociais que visão a proteção integral da Criança e do Adolescente.
