Resumo:This work has as main objective to discuss the penal abolitionism as a key political strategy in the fight against structural barbarism of mature capitalism, especially in the genocidal tradition present in peripheral realities, such as Brazil. The Brazilian penal system, has conflicting nuances in their socio-legal conception, which reproduces on their social legitimacy aspects of inequality and structural and institutional violence. Thus, the document criticizes the Brazilian penal system, dealing with their mechanisms of selectivity, punishment and genocide against the working and subaltern classes, as well identifying the principles based on racist ideology in the hegemonic institutions. In addition to the criticism of the penal system, it’s intended to carry out a brief discussion on criminology, outlining a critical bias, with the introduction of Marxism and the need to treat racism as a primary discussion in the Brazilian critical criminology debate. Still dealing with the critical criminology, is emphasized the abolitionist fight, presenting some forms of strategies of some authors of penal abolitionism.
