Resumo:The present study has as its object the contractual and legal conditions of the workers in the Brazilian university hospitals, contracted with the Brazilian Company of Hospital Services (Ebserh), having as general objective to analyze the contractual and legal conditions of the health workers working in the university hospitals. from his employment, whether he is a celetist (employee of Ebserh) or statutory (linked to the staff of a federal university). The specific objectives were: to characterize the career plan in the two hiring models; compare the description of the common positions to the two bonds and select those of the health area prevalent in the two hiring regimes of the medium and higher levels of education; evaluate the time category of contractual and legal conditions in the workload category and describe the incentive system with respect to salary and benefits. This is a qualitative, descriptive and exploratory study, whose data were collected through documentary research in open databases of Ebserh and the federal government that were organized in spreadsheets and treated using Excel and Iramuteq software. The main results found reveal differences in the description of the same position when it is done by RJU or Ebserh, via CLT; in the value of the hour worked; in the contracted workload; in the social benefits practiced. It is concluded that despite the activities are developed in the same workspace, the contractual and legal conditions are diverse, and there is a clear gap between the workers linked to the RJU and those hired by Ebserh, with advantages for the latter. Thus, it is understood that these differences may generate a management problem and may interfere in the context of personal life, since the guarantees and rewards, if not equitable and similar can cause conflicts and discontent.
