Resumo:The purpose of this research is to propose a procedural flow regulation related to innovation activities within the Brazilian Company of Hospital Services – Ebserh, considering the Constitutional normative context and the specific legislation in force about the promotion of innovation in Brazil. In this sense, the historical rescue of Ebserh is done contextualizing its foundation, foundation´s objective and the current scenario in paralleled by innovation. It´s based on exploratory and bibliographical research, represented by the review of scientific articles available in the database: Scopus, Scielo, DOAJ and Google Academics between 2004 – year of Innovation Law promulgation (Law Nº 10.973/2004) – and the first half of 2018, considering the recent legal changes on the new innovation´s framework (Law Nº 13.243/2016), known as Science, Technology and Innovation Code, as well as the Regulatory Decree Nº 9.283/2018. The secondary data and the legislation survey was done on official websites of the Federal Government and the Legislative. The analysis shows that, although few studies on this subject, the number of published articles on issues related to the innovation law has been increasing, concentrating most of them in the last 5 years, and the first to treat specifically on the theme in 2005. The said regulatory framework translates continuity and deepening concerning the construction of a productive environment of innovative culture.
