Resumo:The purpose of this dissertation is to discuss the personality rights in employment relations. To do so, it addresses fundamental rights in a broad vision with the aim of situating the reader on the range of rights inserted in the area of fundamental rights. It then deals with the fundamental rights of the worker. It reflects on the rights of personality, addressing the civil infra-constitutional legislation in the foreground and soon thereafter, the rights of personality in the work environment. Thus, it analyzes the constitutional, civil and labor court for a better foundation on the subject. It addresses the need to take a closer look at situations of violations of personality rights, seeking ways to reduce abusive employer interference, and then address the issue of employer power. To that extent, it makes a counterpoint between the employer's directive power versus the employee's personality rights. It visualizes the personality rights as mitigable rights depending on the concrete case, since there are no absolute rights. It enters the dignity of the human person, emphasizing its position as value and principle, as well as guiding fundamental rights and decent work. It highlights the need to treat the employee as a citizen, so that he does not strip himself of his rights when entering the work environment. It begins to analyze emblematic situations where there is often an extrapolation of the directive power and consequently a violation to the personality rights of the employee, treating the most emblematic ones in a particularized way. Finally, it reflects on the injury to the employee's.
