Resumo: | The new social arrangements, characteristic of modern and globalized societies,
demand the improvement of democratic mechanisms. Among the possible ways to
achieve this improvement, accountability needs to be highlighted. A concept of
complex nature and difficult translation, it gradually gained space in the discussions
related to the public administration, notably with regard to efficiency gains. Thus, the
present study aims to clarify the elements that make up the concept of accountability,
its main classifications, as well as the way it has been studied by Brazilian doctrine.
In addition, it will discuss the main legal mechanisms present in the country's legal
system that make accountability feasible, as well as the main obstacles to its
implementation, exemplified by cases related to the implementation of the State
Policy on Water Resources. The purpose of the discussion is to investigate how
accountability can contribute to the maturation of the Brazilian democratic
experience, with a view to promoting a realignment between popular aspirations and
the initiatives carried out by their representatives. For that, a large bibliographical
research and case study was carried out, in order to contextualize the research. After
analyzing the collected data, the existence of a confusion related to the
conceptualization of accountability was observed, sometimes confusing it with its
mechanisms. It is also noticed the existence of several constitutional mechanisms,
especially the right to information, contained in art. 5th, XXIII of the Constitution,
which translates into our system the core of accountability. On the other hand, it is
seen that the lack of or excessive delay in the regulation of such mechanisms, lack of
clarity in the distribution of competences and insufficient participatory spaces are
very serious obstacles to the establishment of more effective governance
parameters, which can be reflected in the Inefficiency of public policies. This is what
is verified in the analysis of the State Plan of Water Resources, whose effectiveness
has been hampered by the failures previously mentioned. |
