Resumo:The paper presents a study on the relationship between participative democracy and antitrust protection and its relevance to development. What is sought here is the identification of legal and institutional Brazilian instruments , which will be presented as needed for the expansion of developmental purposes . The theoretical core of this research identifies the extensive and frequent debates about development and relevant academic concern with this phenomenon. The proposal developed here presents as interdisciplinary, encompassing issues of constitutional law, economics and political theory. Thus, it consists in the understanding that development is not a phenomenon that occurs exclusively in the economic field , ie , it is a phenomenon that spans the political and social areas , among other possible perceptions , this study is an analysis of the relationship between the expansion of political freedom and the necessary procedures of interrelation with state bodies that encourage this possibility. For the study conducted here, been treated the actuation of the “Conselho Administrativo de Defesa Econômica”, known as CADE , the agency responsible for maintaining and regulating market and antitrust in Brazil. Thus, an analysis was made of the relational importance of popular participation in the public administration decisions. In this case, the decisions related to antitrust and its relevance to development process. Important to emphasize that this analysis is established in the theory field, considering the incipient development of the phenomenon used as an example , namely , the public consultations used by CADE. Also, It should be noted that in methodological terms were separately identified the main assumptions brought here. Thus, an individualized approach to participative democracy, of free competition and its defense and multiple development concepts was performed. At the end, the question was explained and settled the point that constitutes the core of this study. Observe that the avant-garde character of the present research results in a propositional analysis of large amplitude. Issues involving the legal, political and economic context.
