Examina-se a situação prisional de indígenas nas instituições penitenciárias da cidade de Boa Vista, Roraima, a partir de uma pesquisa realizada nessas instituições desde janeiro de 2008. A prática de encarceramento de indígenas nesta região remonta à ocupação colonial portuguesa que teve início na década de 1770, processo histórico em que os indígenas foram presos e disciplinados em aldeamentos que apresentaram as características de uma “instituição total” da colônia portuguesa. A partir de conceitos de Goffman e Foucault examina-se a história de violência policial contra os indígenas e os paradoxos e ambivalências de uma legislação indigenista de uma sociedade pluralista que reconhece os direitos diferenciados dos povos indígenas ao mesmo tempo em que os operadores do direito aplicam o princípio de que todos são iguais perante a lei. Abstract The situation of Indigenous people in the prisons of the city of Boa Vista, Roraima state, Brazil is examined, from a fieldwork which has been carried out in these institutions from January 2008. The practice of imprisoning Indigenous people in this region goes back to the Portuguese colonial occupation which started in the early 1770s, a historical process in which the Indigenous people were arrested and put under disciplinary measures in settlements which had the characteristics of a "total institution" of the Portuguese colony. From the concepts of Goffman and Foucault, the history of police violence used against Indigenous people and the paradoxes and ambivalences of an pro-indigenous legislation of a pluralist society which recognizes the differentiated rights of Indigenous people parallel to agents of the Law applying the principle that all should be treated equally before the Law.
