The study suggests focusing on the impact of regulation on Open Educational Resources as a key litmus test to assess and improve the effectiveness of rules impacting copyright and education. A contribuição resulta de uma análise jurídica aprofundada dos atuais desenvolvimentos na União Europeia relativamente à lei dos direitos autorais e ao objetivo de uma educação inclusiva e de qualidade. Pretende delinear duas conclusões principais que os países lusófonos podem retirar deste cenário em evolução: a importância de introduzir exceções obrigatórias e uniformes aos direitos de autor e a necessidade de coordenar as práticas de licenciamento aberto entre países com sistemas jurídicos diferentes. O estudo sugere que se centre no impacto da regulamentação sobre os Recursos Educativos Abertos como um teste decisivo para avaliar e melhorar a eficácia das regras que afetam os direitos autorais e a educação.
