The article discusses the nature of the right to territory, defining it as a fundamental right and, based on guaranty constitutionalism, drawing a clear distinction between attributes of fundamental rights and property rights. Based on this distinction, it is concluded that the temporal framework thesis confuses different legal categories, transcends the contours expressed in the constitutional text and thus proves to be incoherent and unconstitutional. O marco temporal da ocupação é um dos grandes instrumentos da luta jurídica para a limitação do direito ao território indígena no Brasil, sendo tese desenvolvida a partir de julgado importante que resultou na demarcação da Terra Indígena Raposa Serra do Sol. O artigo discute a natureza do direito ao território, definindo-o como um direito fundamental e, a partir do constitucionalismo garantista, traçando a distinção nítida entre atributos dos direitos fundamentais e dos direitos patrimoniais. A partir desta distinção, conclui-se que a tese do marco temporal confunde categorias jurídicas distintas, transcende os contornos expressos no texto constitucional e se mostra, assim, incoerente e inconstitucional.
