Objective: to analyze the service capacity of the public health system regarding the existing demand for ICU beds (intensive care unit), associated with the judicialization processes in the State of São Paulo. Methodology: Cross-sectional study consisting of all judgments at the Court of Justice of the State of São Paulo, in the period between 2009 and 2019. The data were analyzed in a descriptive manner and expressed in absolute frequencies. Results: 299 actions were selected for analysis, with the highest demand being the principal author in the private sphere (n = 292). There was an increase in the number of bed demand processes from 2009 to 2019 (n = 66).  Conclusions: one cannot be precise if there is a social inequity, given the lack of information in the judgments to characterize the authorship profile. Introducción: La búsqueda de la judicialización de la salud ha ido creciendo exponencialmente en el país, por lo que un análisis de sus efectos y resultados en el sistema de salud es de suma importancia. Objetivo: Analizar la capacidad de atención del sistema público de salud con respecto a la demanda existente de camas de UCI (unidad de cuidados intensivos), asociada a los procesos de judicialización en el Estado de São Paulo. Metodología: Estudio transversal constituido por todas las sentencias del Tribunal de Justicia del Estado de São Paulo, en el período comprendido entre 2009 y 2019. Los datos fueron analizados descriptivamente y expresados en frecuencias absolutas. Resultados: Se seleccionaron para el análisis 299 acciones, teniendo la mayor demanda como autor principal en el ámbito privado (n=292). Hubo un aumento del 0,66% en el número de procesos de demanda de camas de 2009 a 2019 (n=66). Conclusiones: No es posible precisar si existe inequidad social, dada la falta de información en las sentencias para caracterizar el perfil de autoría. Introdução: A busca pela judicialização da saúde vem crescendo exponencialmente no país e por isso uma análise de seus efeitos e resultados no sistema de saúde é de extrema importância. Objetivos: analisar a capacidade de atendimento do sistema público de saúde referente a demanda existente por leitos de UTI (unidade de tratamento intensivo), associada aos processos de judicialização no Estado de São Paulo. Métodos: Estudo transversal constituído por todos os acórdãos no Tribunal de Justiça do Estado de São Paulo, no período compreendido entre 2009 e 2019. Os dados foram analisados de forma descritiva e expressos em frequências absolutas. Resultados: Foram selecionadas 299 ações para a análise, sendo a maior demanda tendo como autor principal no âmbito privado (n=292). Houve aumento de 0,66% no número de processos de demanda de leitos de 2009 a 2019 (n=66). Conclusões: Não se pode precisar se existir uma iniquidade social, visto a falta de informações nos acórdãos para se caracterizar o perfil da autoria.
