By putting into perspective the laws related to Radio and TV, we observe the contradictions of the Brazilian political scenario and the problems related to the goals of quality and universalization, as well as the concentration of ownership and the lack of democratic criteria for the distribution of conceptions and financing. The sum ofthese factors creates obstacles for the consolidation of democracy in the country, affecting the role of the State and the confrontation of secular social problems. O artigo apresenta um panorama histórico focalizando a regulamentação da Radiodifusão e posteriormente da Internet no Brasil, entre 1910 e 2010. Ao colocar em perspectiva as leis referentes ao Rádio e à TV, observamos as contradições do cenário político brasileiro e os problemas relativos a metas de qualidade e universalização, bem como à concentração de propriedade e à falta de critérios democráticos para distribuições de concessões e de financiamento. A somadesses fatores cria obstáculos para a consolidação da democracia no país, afetando o papel do Estado e o enfrentamento de problemas sociais seculares.
