Through a written request and filed with the Brazilian Legislative Congress, we obtained the transcription of the speeches of the federal parliamentarians about the referred deliberation for the preparation of the 1988 Constitutional Charter. Such speaks constituted our corpus, whose analysis was based on the New Rhetoric (2005), in theses and values categories. Account of theoretical effort of several authors who deal with classroom argumentation, such as Leitão (2007), Baker (2009), Goulart (2011), among others. The article is the result of the completion of the distance learning degree letters' course (EAD) of the Federal Institute of Paraíba – IFPB. From a qualitative perspective and using an essentially inductive but also deductive method, we seek to know the prevalent conclusions in the discussions of the 1988 Magna Brazilian Charter, situated on the millennial institute enfiteuse. The research allowed us to understand that real context analysis may contribute to work argumentation in a Portuguese language classroom. Na Assembleia Nacional Constituinte brasileira de 1987-1988, um caloroso debate em torno da enfiteuse, sua extinção ou permanência, com ou sem modificações, foi travado. Através de pedido escrito e protocolizado junto ao Congresso Legislativo brasileiro, obtivemos a transcrição das falas dos parlamentares federais sobre a referida deliberação para a confecção da Carta Constitucional de 1988. Tais falas constituíram nosso corpus, cuja análise teve como teoria base a Nova Retórica (2005), nas categorias de teses e valores. Conta com o reforço teórico de diversos autores que tratam da argumentação em sala de aula, tais como Leitão (2007), Baker (2009), Goulart (2011), entre outros. O artigo é o resultado do trabalho de conclusão do Curso de Licenciatura em Letras a Distância (EAD) do Instituto Federal da Paraíba – IFPB. Sob uma perspectiva qualitativa e utilizando-se de um método essencialmente indutivo, mas também dedutivo, buscamos conhecer as conclusões prevalentes nas discussões da Carta Magna brasileira de 1988, situadas sobre o instituto milenar enfiteuse. A pesquisa nos permitiu compreender que análises de contextos reais poderão contribuir para trabalhar argumentação em sala de aula de Língua Portuguesa.
