Pachukanis’ original theory of legal form as a commodity and its implications on three essential elements for the creation and legitimation of Western law: the social pact, the contract and the morality of man O artigo apresenta o sujeito de direito, categoria jurídica fundamental, na teoria da forma-jurídica como forma-mercadoria do soviético E. B. Pachukanis (1891-1937), para então analisar os potenciais críticos e de construção desta teoria em relação aos modelos hegemônicos do direito. Fundamentada em pressupostos epistemológicos marxistas, a Teoria Geral do Direito e Marxismo (1924) apresenta-se como variação e contribuição necessárias ao debate contemporâneo da teoria jurídica, distanciando-se tanto dos próprios teóricos e juristas marxistas de sua época quanto por ser uma alternativa ao positivismo liberal de Hans Kelsen e H. L. A. Hart e ao decisionismo de Carl Schmitt. O artigo especificamente critica o sujeito de direito na teoria da forma-jurídica em três elementos cruciais do direito (pacto social, contrato e moralidade do ser humano), confrontando, por fim, as potencialidades da teoria da forma-jurídica de Pachukanis em relação às suas rivais, principalmente a liberal-positivista, bem como certos importantes limites internos à própria teoria.
