Therefore, the aim is to identify the related constitutional principles, as well as to interpret the causes that led to the implementation of the expansive hypotheses in the penal text. For that, it was necessary to analyze the Constitution, the penal legislation and the new bills. In the end, it seeks to analyze the clashes between the aspects of public security and the principles of the Democratic State of Law. Thus, it will be possible to comprehend, through the understanding of legal doctrines thinkers., the mismatch between the normative, the social fact and the values recognized by the bills. O presente artigo tem como objetivo analisar as propostas normativas recentemente discutidas pelos Poderes Legislativo e Executivo quanto à ampliação das excludentes de ilicitude no Código Penal Brasileiro, apresentadas na tentativa de resguardar a atuação de agentes militares no combate à criminalidade durante as Operações de Garantia da Lei e da Ordem. Logo, visa-se identificar os princípios constitucionais relacionados, bem como interpretar as causas que propiciaram a implementação das hipóteses ampliativas no texto penal. Para tanto, foi necessária a análise da Constituição, da legislação penalista e dos novos projetos de lei. Ao fim, busca-se analisar os embates que há entre os aspectos da segurança pública e os princípios do Estado Democrático de Direito. Destarte, foi possível identificar, à luz do entendimento de doutrinadores do direito, o descompasso entre a normatividade, o fato social e os valores estabelecidos pelos projetos de lei.
