In Brazil, the performance of criminological examinations with the aim of verify the "ability to the return to society" is the most controversial practice in the execution phase, receiving criticisms of several orders. In order to promote a philosophical analysis about the question, this article used the linguistic assumptions of Ludwig Wittgenstein to identify, through bibliographic research, the possible inconsistencies caused by language in these personality exams. It was possible to conclude that the so-called "pathologies of language" may be responsible for stereotypes implicit in technical assessments, which is why the conclusions found should not be taken as the maximum expression of truth. A prática clínica na execução penal é um dos objetos centrais da crítica criminológica desde a transição do paradigma etiológico para o da reação social, ocupando um grande espaço de tensionamento entre o sistema de justiça criminal e os estudos acerca do crime e da violência. No Brasil, a realização de exames criminológicos com o objetivo de aferir a “aptidão ao retorno ao convívio em sociedade” constitui a prática mais controversa da fase executória da pena, recebendo críticas de diversas ordens. Assim, visando promover uma análise filosófica acerca da questão, o presente artigo se utilizou dos pressupostos linguísticos de Ludwig Wittgenstein para identificar, através de pesquisa bibliográfica, as possíveis inconsistências causadas pela linguagem nesses exames de personalidade. Foi possível concluir que as denominadas “patologias da linguagem” podem ser responsáveis por estereótipos implícitos nas avaliações técnicas, razão por que as conclusões encontradas não devem ser tomadas como expressão máxima de verdade.
