In a comparative perspective, and through eminently bibliographic research, it is sustained here that impeachment is an institute of a mixed nature, combining political and legal elements, according to the model pioneered by American constitutionalism. Thus, the tension between law and politics, inherent to the impeachment, prevents attempts of presidential remove without demonstrating the practice of any offense disapproved by the constitutional order, especially in the Brazilian case in which the 1988 Constitution requires a special law to define the impeachable offenses and establish its rules of procedure and judgment, adopts the principle of nullum crimen sine lege and the Supreme Court, in line with its historically constructed jurisprudence, understands the institute as having, at least in part, a juridical-criminal nature. O objetivo deste artigo é demonstrar que a exigência de tipificação das impeachable offenses está na raiz da distinção da forma de responsabilização política existente nos sistemas parlamentarista e presidencialista de governo, a partir da forma pela qual referidas ofensas foram compreendidas no caso Andrew Johnson. Em uma perspectiva comparada, e mediante pesquisa eminentemente bibliográfica, sustenta-se, aqui, que o impeachment é um instituto de natureza mista, combinando elementos políticos e jurídicos, segundo o modelo pioneiramente estabelecido pelo constitucionalismo estadunidense. Sendo assim, a tensão entre Direito e política, própria do instituto do impeachment, impede tentativas de destituição presidencial sem que haja demonstração da prática de alguma ofensa reprovada pela ordem constitucional, mormente no caso brasileiro em que a Constituição de 1988 exige que lei especial defina os crimes de responsabilidade e estabeleça suas regras de processo e julgamento, adota o princípio do nullum crimen sine lege e o Supremo Tribunal Federal, na linha da sua jurisprudência historicamente construída, compreende o instituto como possuindo, pelo menos em parte, natureza jurídico-penal.
