Thus, international complaints and mismanagement of Brazilian prisons during the pandemic period were examined, which became strong exhibitors of the necropolitics practiced by the federal government. In this way, it is analyzed how the international instances, under the aegis of transconstitutionalism, are important for the change of national paradigms. The research methodology is qualitative, with documentary analysis of resolutions and official reports of the Organization of American States; bibliographic research, through academic articles and books, and journalistic research. The work concludes on the importance of the action of external bodies and on the influence of international law within Brazilian criminal policy. O presente artigo discorre sobre a rápida disseminação do novo coronavírus (COVID-19) dentro dos presídios brasileiros, trazendo à tona um diálogo com o que dispõe a criminologia crítica acerca das características coloniais do cárcere no Brasil, enraizado em um passado punitivo perpetuado através dos mecanismos de controle de corpos encarcerados. Assim, recorreu-se às denúncias em nível internacional e à má gestão das penitenciárias brasileiras no período pandêmico, que se tornaram fortes expositoras da necropolítica praticada pelo governo federal. Dessa forma, analisa-se como as instâncias internacionais, sob a égide do transconstitucionalismo, são importantes para a mudança de paradigmas nacionais. A metodologia de pesquisa é qualitativa, com análise documental de resoluções e relatórios oficiais da Organização dos Estados Americanos; pesquisa bibliográfica, em artigos acadêmicos e livros, e pesquisa jornalística. O trabalho conclui sobre a importância da ação de organismos externos e sobre a influência do direito internacional dentro da política criminal brasileira.
