In the neoliberalismo context, the way people deprived of their liberty are treated in the public space and read by society is a direct consequence of the dynamics of incarceration and punitivism rooted in society, therefore, it is necessary to evaluate the current situation within a pre-existing context of politics and economics. Based on this problem, the present study proposes to analyze the Executive and the Judiciary omission in providing means to avoid aggravating the contamination of Covid-19 in the prison and socio-educational system, which can be seen as an expression of necropolitics and state violence. Even after recommendations by the National Council of Justice, many judges refuse to reduce the number of people in prison, and the responses so far offered to alleviate the situation have not been effective. Em tempos de pandemia, tem havido um silencioso genocídio da população prisional brasileira, que se manifesta por meio do crescente e sistemático número de mortos e infectados por coronavírus entre presos e servidores que trabalham nesses ambientes. No contexto do neoliberalismo, a forma como as pessoas privadas de liberdade são tratadas no espaço público e lidas pela sociedade é consequência direta das dinâmicas de encarceramento e punitivismo enraizadas no seio social, sendo assim, faz-se necessário avaliar o quadro atual dentro de um contexto pré-existente de política e economia. A partir dessa problemática, o presente estudo se propõe a analisar a omissão do Executivo e do próprio Judiciário em providenciar meios para evitar o agravamento do quadro de contaminação por Covid-19 no sistema prisional e socioeducativo, o que pode ser interpretado como uma expressão de necropolítica e violência estatal. Mesmo após recomendações do Conselho Nacional de Justiça, muitos juízes se recusam a reduzir o número de pessoas presas, e as respostas até agora oferecidas para atenuar a situação não foram efetivas.
