Forthis, it will be presented how the process that promoted the inversion inthe interpretation for the granting or not of thebenefit under study.Within the interpretative evolution, it is intended to present that this isa necessary right, although there are certain requirements for itsconcession. In addition, it addresses the fact that mothers or guardiansof children or disabled people are the direct beneficiaries of themeasure, but it is the vulnerable ones that must be effectivelysafeguarded. Thus, in the end, it will be demonstrated that there areexceptions to the right under analysis, but always with the objective ofpreserving the rights of the child or the disabled. O presente artigo objetiva analisar o instituto da prisão preventivadomiciliar e as recentes alterações legais e jurisprudenciais sobre o temano Brasil. Para isso, será apresentado como foi o processo quepromoveu a inversão na interpretação para a concessão ou não dobenefício em estudo. Dentro da evolução interpretativa, busca-seapresentar que este é um direito necessário, embora existamdeterminados requisitos para sua concessão. Além disso, aborda-se ofato de que mães ou responsáveis por crianças ou deficientes são osbeneficiários diretos da medida, mas são os vulneráveis que devemefetivamente ser resguardados. Assim, ao final, demonstrar-se-á queexistem exceções ao direito em análise, mas sempre com o objetivo depreservar os direitos da criança ou do deficiente.
