This article approved a study on the impact of the Laws of Criminal Organizations (Law 12,850 of 2013) and Antiterrorism (Law 13,260 of 2016) in the renewal and intensification of the criminalization process of popular social movements in Brazil. For that, the article was constituted by a historical and dialectical analysis, through successive approximations between the legal forecast and its material impacts. Initially, there was a brief presentation of the theoretical-criminological view on the subject of criminal policy in the country. Then, a legal technical analysis of the legislative laws was carried out, confronting the empirical evidence that evidences this criminalization and addresses the sociological questions that make it possible to recognize the effects of the application of these norms in the struggles of popular social movements through a system of justice with predominantly punitive action.   Este artigo propõe um estudo sobre o impacto das Leis de Organizações Criminosas (Lei n. 12.850 de 2013) e Antiterrorismo (Lei n. 13.260 de 2016) na renovação e intensificação do processo de criminalização de movimentos sociais populares no Brasil. Para tanto, o artigo foi constituído, desde uma análise histórica e dialética, por meio de sucessivas aproximações entre a previsão legal e seus impactos materiais. Inicialmente, realizou-se uma breve exposição da visão teórico-criminológica acerca do tema da política criminal no país. Em seguida, desenvolveu-se uma análise técnico-jurídica das referidas legislações, confrontando-as com episódios empíricos que evidenciam essa criminalização e abordagens sociológicas que possibilitam o reconhecimento dos impactos da aplicação destas normas nas lutas dos movimentos sociais populares por meio de um sistema de justiça com atuação predominantemente punitivista.
