Resumo:This article approved a study on the impact of the Laws of Criminal Organizations (Law 12,850 of 2013) and Antiterrorism (Law 13,260 of 2016) in the renewal and intensification of the criminalization process of popular social movements in Brazil. For that, the article was constituted by a historical and dialectical analysis, through successive approximations between the legal forecast and its material impacts. Initially, there was a brief presentation of the theoretical-criminological view on the subject of criminal policy in the country. Then, a legal technical analysis of the legislative laws was carried out, confronting the empirical evidence that evidences this criminalization and addresses the sociological questions that make it possible to recognize the effects of the application of these norms in the struggles of popular social movements through a system of justice with predominantly punitive action.
